Terms of Service

1. Service Description

NoSFeR Tech provides an AI-powered WhatsApp chatbot service that automates appointment booking, customer inquiries, and schedule management for businesses ("the Service").

2. Subscription Plans

The Service is offered through three subscription tiers (Starter, Pro, Enterprise) with monthly or annual billing. Prices are in USD and do not include applicable taxes. There are no setup fees.

3. Free Trial

New clients receive a 14-day free trial with full functionality and no payment required. During the trial period:

  • The chatbot is configured with the client's real business data
  • No credit card or payment information is required
  • The client may cancel at any time without obligation
  • If the client does not activate a paid subscription, the service is deactivated after 14 days

4. Commitment Period

Upon activating a paid subscription after the free trial, the client agrees to an initial commitment period of 6 months with monthly billing.

  • First 30 days (grace period): The client may cancel without penalty, paying only for the month consumed
  • Months 2 through 6: Early cancellation requires payment of 50% of the remaining months in the commitment period
  • Month 7 onward: The subscription continues month-to-month and may be canceled at any time with 30 days written notice

5. Annual Billing

Clients may opt for annual billing at any time, paying for 10 months and receiving 12 months of service (2 months free). Annual subscriptions are non-refundable. At the end of the annual period, the subscription renews automatically under the same terms unless canceled with 30 days written notice before the renewal date.

6. Service Level

We commit to:

  • 99.5% uptime for the chatbot service
  • Response time under 3 seconds for standard queries
  • 24/7 automated monitoring with alert escalation
  • Daily automated backups of all data

7. Client Responsibilities

The client is responsible for:

  • Providing accurate business information (services, hours, pricing)
  • Maintaining an active WhatsApp Business account
  • Keeping Google Calendar up to date with actual availability
  • Complying with applicable data protection laws in their jurisdiction

8. Limitations

The chatbot uses AI to understand natural language. While we maintain a 99.3% accuracy rate in automated testing, we do not guarantee 100% accuracy in all interactions. Complex or ambiguous requests may require human intervention.

9. Data Ownership

All client business data (service catalog, pricing, schedules) remains the property of the client. Conversation data and appointment records are jointly accessible. Upon termination, clients can request a full data export.

10. Cancellation

Cancellation is subject to the commitment period terms described in sections 4 and 5. Upon cancellation:

  • The chatbot will be deactivated at the end of the current billing period
  • Client data will be available for export for 30 days after deactivation
  • After 30 days, all data will be permanently deleted
  • Early cancellation fees, if applicable, will be invoiced separately

11. Liability

NoSFeR Tech's liability is limited to the amount paid by the client in the 3 months preceding the claim. We are not liable for missed appointments, lost revenue, or damages arising from chatbot interactions.

12. Governing Law

These terms are governed by Spanish law. Disputes will be resolved in the courts of Madrid, Spain.
